    内容提要：改革阻碍知识产权市场化运营的体制机制，实现知识产权从法权化向市场化的转变，对于推动经济体制转型、建设知识产权强国、完善知识产权法律制度，具有重要意义。知识产权市场化改革不可能一蹴而就，必须运用法治思维和法治方式推进改革，在市场化改革进程中转变政府职能，建设法治政府和服务型政府，同时构建知识产权市场化政策体系，找准改革的着力点和突破口。

    Abstract: It is of great importance to reform the institutional mechanisms that hinder market-oriented operations of intellectual property, and transit intellectual property from rights to market interests, because they can promote economic system transformation, build powerful country of intellectual property, and improve the intellectual property legal system. Market-oriented reforms of intellectual property rights cannot be achieved in one move, we must apply the thinking way of law to push reform, transform government functions in the process of market-oriented reforms, construct law-based and service-oriented government, build market-oriented policy system of intellectual property, and identify the focal points and break throughs of reforms.
