内容提要:游戏作品的著作权问题比想象的要重要和复杂。游戏作品的表现形态千变万化,著作权法应区别对待它的“文本”本身固定的内容与游戏运行过程中临时呈现的内容,进而在必要时将它视为多种类型的传统作品的集合体,而没有必要创设特殊的作品类型。游戏用户的行为同样不能简单定性,需要根据游戏的具体情况判断游戏用户是否构成游戏画面的演绎作者。用户公开播放或通过网络传播游戏画面的行为落入游戏开发者的多项著作权权能的覆盖范围。这些行为是否构成合理使用,需要结合个案的事实具体分析。

Abstract: Copyright issues of computer games are far more important and complex than what one might have imagined. The forms or patterns of computer games differ in thousands ways. Copyright law should treat separately the content fixed by the “literal text” of computer software and the content temporarily displayed on a player’s screen during a game process. If necessary, a work of computer game can be viewed as a collection or compilation of various types of traditional copyrightable works. Copyright law does not need to create a special category for computer games. The legal role of game players is hard to characterize. Whether a player should be viewed as an author of its gameplay video depends on the specific nature of a computer game. Making gameplay videos available to the public or playing computer games in public falls into the scope of exclusive copyrights enjoyed by game developers. The availability of fair use defense is subject to the analysis of the particular facts in individual cases.
