内容提要：政府主导模式的当然许可制度虽然对于专利实施转化的双方都有一定的正向激励作用，然而，政府介入所产生的实际效率可能会随其介入程度的加深而递减。提供当然许可的制度供给中，我国可以探索建立市场主导模式的当然许可制度，从而规避政府主导模式的当然许可制度中存在的弊端。在理清当然许可制度中各相关主体间法律关系的基础上，由法律授权行政机关在实践中探索建立市场化模式的当然许可制度较为稳妥。

Abstract: Government-led license of right system may provide positive incentives to both parties of patent exploitation, however, the actual efficiency generated by government interference may decrease in the long run. China may explore the way to construct the market-based license of right system instead of the government-led pattern. Having clarified the legal relationships among relevant legal entities of the license of right system, it is recommended to authorize the administrative organ by law to explore the way to establish a market-based license of right system.
