内容提要：近年来，日益广泛的公众参与成为知识产权法治进程中值得注意的现象。公众对知识产权立法、司法等活动积极关注、发表意见，以及运用知识产权制度实现自身权利，是其参与知识产权法治的两种主要方式。依次分析公众参与知识产权法治的成因、意义及局限，在此基础上提出了更好地发挥公众参与以促进知识产权法治水平的意见。特别地，法治进程中的公众参与是法学领域一个普遍命题，在兼顾一般问题的基础上，结合知识产权法的自身特点着重分析知识产权领域公众参与的特殊之处。

Abstract: It has become a phenomenon that public participation in constructing rule of law in the field of intellectual property has been increasing fast. The public participation consists of two types. One is that the public pay more attention on the legislative and judicial activities, and the other is that the public apply the legal system to realize their intellectual property rights. The article analyses the cause, influence and limitation of public participation in constructing the rule of law in the field of intellectual property, and provides some suggestions on promoting the effect of this participation. It is a general proposition for the public to participate the construction of rule of law; however, the paper puts emphasis on the specialty of public participation in IP rule of law construction..
