内容提要：网盘存储服务因其私密性与便捷性备受公众关注，当前的网盘存储服务已经形成完整的产业链，其客观上为侵权内容的传播提供了极大的技术支持。作为处于产业链核心的网盘存储服务商，其应承担相应义务，避免直接侵权的产生，或侵权结果的扩大。网盘存储服务商在本质上仍属于信息存储空间服务商，但基于网盘存储空间的私密性和相对封闭性，以及缺乏公开运营的平台，网盘存储服务商无法控制网盘空间中存储的内容及其公开传播，这对其版权义务和责任的承担会产生一定的影响。基于法律的规定以及操作性和运营成本考量，网盘存储服务商不应承担用户存储或分享内容的版权审查义务，但是应尽到相应的注意义务，即根据“通知和移除”规则要求，及时删除侵权内容和断开侵权分享链接，同时采取必要技术措施筛查明显的侵权内容，监控用户账号异常登录和流量的异常变化，及时采取应对处理。

Abstract: Online disk service attracts great public attention because of its privacy and convenience. Nowadays, online disk service has formed a complete industrial chain, which greatly facilitates the dissemination of infringing content. The online disk service providers, as the pivot of the industrial chain, should assume the obligations to avoid direct infringement, and prevent the expansion of infringement. Essentially, online disk service providers are information storage service providers; however, considering the private and closed nature as well as the lacking of public operation platform, the online disk providers are unable to interfere with the stored content and its dissemination, which impact the their copyright obligation. Taking into account of cost and other factors, online disk service providers should not assume obligations to review the content stored and shared by the users, but they should undertake the duty of care in line with the “notice-takedown rules”, removing infringing content and disconnecting infringing links, while taking necessary technical measures to screen the obviously infringing content and monitoring unusual data flow.
