内容提要:学界在关于著作权集体管理组织垄断性问题的相关著述中,宏观层面多提倡引入竞争,放松市场准入;微观层面多强调私权绝对与意思自治。其中观点均有其自在的价值基础,但在理论上,著作权集体管理是具有自然垄断特点的行业。此外,作为著作权法实施的补充性保障,著作权法立法目标的多元性也决定了著作权集体管理组织功能定位的多元性。著作权集体管理组织在相关领域内的垄断地位乃是实现其多元功能的前提和保障。建议以著作权集体管理组织多元的功能定位为讨论基础,辩证理解民法基本原则所追求的价值目标,在肯定垄断式集体管理组织存在正当性的前提下,着力完善《著作权法》和《著作权集体管理条例》的制度建设,特别强化对著作权集体管理组织外部执业活动和内部治理运行的监督。

Abstract: In the
discussion of Anti-Monopoly Control of CMOs, most of the scholars encouraged
the introduction of competition among CMOs. Meanwhile, they suggested that more
autonomy of the right-holders should be introduced into the governance of the
CMOs. These suggestions to some extent make scene. However, in the process of
analysis they haven’t taken the features of CMOs as a natural monopoly industry
into consideration. Furthermore, as the safeguard instrument of the Copyright
Law, the functions of COMs should be analyzed under Copyright Law, which means
the functions of CMOs are also multiply. In order to achieve the
multiplefunctions of CMOs, the monopoly position of CMOs should be suggested.
this paper advises against introducing competition among CMOs in China. Instead
of that, the control mechanism, however, have to be upgraded by amendment of
Chinese Copyright Law and the Regulation of CMOs, especially the improvement of
control-system concerning the activities of CMOs and the governance of
CMOs.
